Terms of Service

By creating a Trinsfer account or using the service, you agree to these Terms of Service. They form a legal agreement between you and Trinsfer Labs. Please read them carefully.

1. The service

Trinsfer provides an online file-transfer service ("Transfers"), a real-time internet speed-test service ("Speed"), a digital-goods marketplace where creators sell files ("Sell" or "Marketplace"), a dashboard for managing them, and a REST API ("API"). Together these constitute the "Service".

2. Eligibility & accounts

You must be at least 16 years old (or 13 with verifiable parental consent) to use Trinsfer. By signing up, you confirm the information you provide is accurate. You are responsible for keeping your password and API keys confidential, and for all activity on your account.

3. Acceptable use

You agree not to use Trinsfer to:

• Host, distribute, transmit or store content that is illegal, infringing, defamatory, fraudulent, malicious, harassing or otherwise objectionable;
• Distribute malware, viruses, trojans, ransomware or any software designed to harm computers or data;
• Bypass technical limitations of the service (rate limits, expiration times, payment requirements);
• Resell the service as your own product without an Enterprise agreement;
• Use automated tools that put a disproportionate load on our infrastructure;
• Violate any export-control, sanctions or anti-money-laundering laws.

We may suspend or terminate any account that violates these rules without prior notice.

4. Subscriptions, payment & refunds

Free accounts have transfer-size and expiration limits. Pro plans (Monthly $9.99 and Annual $99.99) extend those limits as described on the Pricing page. Subscriptions are one-off payments for the period purchased — they do not auto-renew. We accept PayPal and crypto (Crypto).

If you are in the EU or UK, you have a 14-day right of withdrawal, except where you actively use Pro features during that period (Art. 16(m) of Directive 2011/83/EU on the supply of digital content). Refund requests outside the 14-day window are at our discretion.

5. API plans

Business and Enterprise API plans are governed by additional terms attached to the order form. Per-minute rate limits, monthly request quotas and SLA commitments are specified there.

6. Trinsfer Sell — marketplace for creators

Trinsfer Sell lets registered users ("Sellers") publish and sell digital products (files, folders and subscriptions) to "Buyers". By publishing a product you represent that you own or have all necessary rights and licenses to the content, and that its sale and distribution do not infringe any third-party intellectual-property, privacy or contractual rights, and do not violate Section 3 (Acceptable use).

• Prohibited products include malware, pirated or counterfeit goods, stolen data, sexual content involving minors, and anything illegal in Spain or the Buyer's country.
• Sellers may be required to complete identity verification (KYC) before requesting payouts.
• You are solely responsible for the accuracy of your product descriptions, prices, taxes and for honoring what you advertise.
• Trinsfer acts only as a technical intermediary and payment facilitator; the contract of sale is between Seller and Buyer.

7. Adult content & age-restricted material

Trinsfer permits the sale of lawful adult (18+) content on the Marketplace only where expressly enabled for a Seller and subject to the additional rules in this Section. By publishing, distributing or marketing any sexually explicit or otherwise age-restricted material, the Seller represents, warrants and agrees that:

• Age & identity verification (KYC). The Seller is at least 18 years old (or the age of majority in their jurisdiction, whichever is higher) and has completed Trinsfer's identity-verification (KYC) process. Trinsfer may require KYC re-verification at any time and may suspend adult listings and withhold payouts until verification is complete.
• Consent & record-keeping. Every identifiable person appearing in the content is an adult who has given written, informed and revocable consent to the recording and to its commercial distribution. The Seller maintains age- and consent-verification records (e.g. compliant with U.S. 18 U.S.C. §2257 and equivalent local laws) and will provide them to Trinsfer or competent authorities on lawful request.
• Strictly prohibited. Content depicting or involving minors or anyone appearing to be a minor, non-consensual acts, "revenge porn" or intimate media shared without consent, sexual violence, bestiality, incest, trafficking, or any content that is illegal in Spain or in the Buyer's country, is absolutely forbidden and will be removed and reported to the authorities, with immediate account termination and forfeiture of funds.
• Mandatory labelling & gating. Adult products must be honestly marked as adult; Trinsfer applies age gates, blurred previews and may restrict discovery, indexing and availability by region. Sellers must not attempt to bypass these controls or mislabel adult content as general-audience.
• Delivery restrictions. To protect creators and the platform, Trinsfer may require that adult content be delivered through approved methods (including external/own-hosting delivery) rather than stored on Trinsfer servers, and may decline to host certain categories of files.
• Third-party processors. Payment providers (PayPal, card networks, crypto processors) impose their own restrictions on adult content. Trinsfer is not liable for a processor declining, holding, reversing or freezing funds relating to adult transactions, and may disable particular payment methods for adult listings.
• Taxes & compliance. The Seller is solely responsible for all legal, licensing, labelling, age-verification and tax obligations applicable to adult content in every jurisdiction where it is offered.

Trinsfer may, at its sole discretion and without prior notice, remove any adult listing, disable adult features for an account, or terminate an account that violates this Section or applicable law. Report illegal or non-consensual material immediately to abuse@trinsfer.com.

8. Fees, payouts & buyer protection

Trinsfer charges a platform fee on each Marketplace sale, shown to the Seller before publishing and at checkout. The remaining net amount is credited to the Seller's wallet and becomes available for payout after a hold period (used for fraud and chargeback protection). Minimum payout amounts and supported payout methods (PayPal, crypto, Stripe) are configured by Trinsfer and may change.

Buyers receive instant access to purchased files after a successful payment. Because digital goods are delivered immediately, all sales are generally final; however, if a product is materially not as described, fraudulent, or inaccessible, Buyers may request a refund at support@trinsfer.com within 14 days. Trinsfer may reverse a Seller's funds in cases of confirmed fraud, chargebacks or policy violations. Payments are processed by PayPal and Crypto under their own terms.

9. Intellectual property

Trinsfer, its logo and the look-and-feel of the service are owned by Trinsfer Labs. You retain all rights to the files and content you upload — uploading does not grant us any ownership; we only obtain the limited license needed to store and deliver your content to the recipients you choose.

10. Content removal

We may remove content or terminate transfers that we reasonably believe violate Section 3, applicable law, or third-party rights, including takedown requests under the DMCA / EU Digital Services Act. Send abuse reports to abuse@trinsfer.com.

11. Disclaimer of warranties

The Service is provided "as is" and "as available". We make commercially-reasonable efforts to keep it running 24/7 but do not warrant that it will be uninterrupted, error-free, or that all files will be delivered without delay. Use at your own risk.

12. Limitation of liability

To the maximum extent permitted by law, Trinsfer's aggregate liability to you for any claim arising out of the Service is limited to the amount you paid for the Service in the 12 months preceding the claim, or USD 100 — whichever is greater. We are not liable for indirect, incidental, special, consequential or punitive damages, including lost data, profits or opportunity.

13. Termination

You may close your account at any time by deleting it from the dashboard. We may suspend or terminate access if you breach these Terms. Files associated with terminated accounts are deleted within 30 days.

14. Governing law

These Terms are governed by the laws of Spain. Any dispute will be brought before the competent courts of Madrid, unless mandatory consumer-protection laws of your country of residence provide otherwise.

15. Changes

We may update these Terms from time to time. Material changes will be notified by email at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the new Terms.
